The user (“customer”, “you”, “visitor”) signifies unconditional acceptance of these Terms and Conditions upon visiting the website of Marine Plaza (“us”, “we”, Marine Plaza T.V.T. Ltd.”). The Terms and Conditions may change without notice and continued usage of our website signifies your acceptance of these changes.

 

By using our website you state you are of the age of majority in the province of Ontario, Canada. If you are not of this age of majority you must be accompanied by and under the supervision of a parent or legal guardian who agrees to our Terms and Conditions. Legal Guardians and/or supervisors of minors are responsible for their usage of our website including all financial charges, liabilities and costs the minor may incur.

 

Although we try to maintain a match between our online and in-store pricing, pricing, products, and features advertised on our website may differ from our in-store selection. Market conditions, competition, and supply chain factors may cause prices and availability to change without notice. Marine Plaza does not always offer the same in-store pricing as online. Website pricing is only secured upon adding to cart and purchasing via checkout. Unavailability of a product after purchase is a possibility. Marine Plaza will contact you if delivery is jeopardized. Always contact us to try and obtain real-time information. We reserve the right to change and/or correct any pricing or description of items.

 

We reserve the right to limit any sale or (quantity of) product(s), to any purchaser. We may reject, cancel, correct or simply refuse delivery of any item(s) purchased via our website without limitations. The aforementioned condition disregards payments made in part or full of purchased items. All product specifications and approximate and provided to Marine Plaza T.V.T. Ltd. by a third party. Although we attempt to accurately relay to you information provided to us by our suppliers and vendors, the accuracy of such is the sole responsibility of our vendors and suppliers. We do not warrant any accuracy provided on our website. You cannot hold Marine Plaza liable for any specifications, description or instructions or any product communication provided through our website or in-store experience. Prices are given in Canadian Dollars and to not include any applicable taxes.

 

Our website may only be used by Canadian residents. Access by users outside of Canada is done at your own risk. Marine Plaza is not liable for the usage of any products or statements available to you from our website in your region. Marine Plaza T.V.T. Ltd. charges the applicable sales tax for Ontario to its products.  Effective July 1, 2010 this amount is 13%.

 

Marine Plaza is not responsible for late, lost, stolen, damaged, incomplete, and illegible or any falter in connection with the product purchase, delivery, and order. You will not hold responsible Marine Plaza T.V.T. Ltd. for unavailable network connections, failed, incomplete, garbled, delayed or inaccurate computer transmissions, software and/or hardware failures, online failures, technical malfunctions or disturbances or any other technological and communicational failures affecting or corrupting our online experience. No indemnity shall be held against us for damages or viruses affecting your hardware and/or software computer equipment in connection with your access, whatever usage, of our website. You are strongly prohibited from corrupting, violating, or attempting to violate the security of our website.  Any corruptive and “hacking” behavior will be treated as a crime by the fullest available measures.

 

Any communication or materials sent to or via our website will be assumed non-confidential and non-proprietary.  Any information brought forth to Marine Plaza electronically may be used by us and/or our affiliates for any purpose within the laws of Ontario.  This may include, but does not limit use to, reproduction, disclosure, transmission, publication, broadcasting, and posting. We may freely use any ideas, concepts, techniques and other information communicated to us by you, the website visitor free of any responsibility or compensation to you, for any purpose we deem fit.

 

Any materials on this website must be assumed protected by copyright. Marine Plaza T.V.T. Ltd. without limit, does not transfer right, title, ownership or interest to you in any case. This includes but is not limited to downloading or copying any content on our site.  You may not copy, republish, reproduce, modify, display, post download, share or do anything with the content on our website. The content on our website is for informative and purchasing end means only. Any other use will be strictly enforced and controlled by Marine Plaza. 

 

If in any case the aforementioned is compromised and Marine Plaza T.V.T. Ltd. is to be found liable for any loss or damage that is proven to have arisen through use of our website the liability of Marine Plaza shall in no event exceed $250 CAD. You explicitly agree to these Terms and Conditions through the use of our website.  You shall not indemnify Marine Plaza and any and all of its officers, directors, employees, third party associates, contractors, agents and representatives against any claims or actions brought against us as a result of your use of our website.

 

Marine Plaza shares a number of Third Party links to enhance your web browsing enjoyment. These Third Parties are not associated or affiliated nor partnered with Marine Plaza. Third Party links navigate you away from the Marine Plaza website and therefore, if you decide to enter any other website, you do so at your own risk. Framing of the Marine Plaza website is strictly prohibited and fought against by law.

 

Marine Plaza T.V.T. Ltd. shall govern these Terms and Conditions, in accordance with the laws of  the province of Ontario, Canada.  Disputes arising from your use of this website are to be disputed in this court of law.
